Practitioners holding an active New York license may provide teletherapy services to New York residents.
NY CLS Pub Health § 2999-dd gives the Department of Health Authority to provide guidance on Telehealth. Article 29-G of the NY Consolidated Laws regarding public health states that telehealth shall not include delivery of health care services by means of facsimile machines, or electronic messaging alone, though use of these technologies is not precluded if used in conjunction with telemedicine, store and forward technology, or remote patient monitoring.
