Hi there! I've been working through the LPCC Law and Ethics Exam materials (in California). I was wondering if anyone could help me understand the difference between parents/adults who can consent for a minor vs. parents/adults who may not be able to content, but still have the right to access a minor's records. (1) If one legal guardian is consenting for a minor's treatment, but a non-legal bio parent (not able to consent) wants access to the minor's records - this non-legal bio parent will still be able to - is that correct? (2) Are foster parents, stepparents, or other non-legal guardians able to access the minors records? What about a father who's "paternity is at issue"? (3) Can a minor (say 13 yrs old) consenting to their own treatment review their records? (4) Can an adult under conservatorship review their records?
